Under Swiss law, a seller may be liable for defects in a sold vehicle if the defect already existed at the time of delivery and substantially reduces the vehicle’s value or its suitability for normal or agreed use.
These rights are commonly referred to as:
statutory warranty, warranty for defects, Sachgewährleistung, Gewährleistung, or liability for defects.
A legally relevant defect may include, for example:
a hidden mechanical, technical, electrical, or structural defect that existed before delivery;
incorrect information about mileage, accident history, service history, ownership, import status, condition, or equipment;
a missing agreed feature, accessory, or vehicle document;
a legal defect, such as unclear ownership, third-party rights, or restrictions affecting transfer of ownership;
a serious defect that substantially reduces the vehicle’s value, roadworthiness, or normal use.
Normal age-related wear, normal deterioration, maintenance requirements, service items, and defects clearly disclosed before purchase are generally not treated in the same way as hidden legal defects.
Customers should inspect the vehicle carefully at handover or delivery and notify Ämmitau Garage GmbH immediately if they discover a defect.
The customer’s notification should be made in writing and should include:
full customer name and contact details;
vehicle make, model, registration number, VIN, and mileage;
purchase date and handover or delivery date;
a clear description of the defect or complaint;
photos, videos, diagnostic reports, or workshop findings, where available;
details of any warning lights, unusual noises, leaks, faults, or symptoms;
confirmation of whether the vehicle is still being driven.
Notice of defects should be sent to:
Ämmitau Garage GmbH
Brandisstrasse 25
3432 Lützelflüh-Goldbach
Switzerland
Email: info@falchauto.com
Telephone: (+41) 555 391 873
Customers should not continue using a vehicle if doing so may worsen the damage or create a safety risk.
For movable goods in Switzerland, warranty claims generally expire after two years from delivery.
For new goods sold to consumers, the seller generally cannot shorten that period.
For used goods sold to consumers, the period may generally be shortened, but not to less than one year, unless a lawful exception applies.
The exact warranty position depends on:
whether the vehicle is new or used;
whether the customer is a consumer or business buyer;
the vehicle’s age, mileage, condition, and disclosed defects;
the individual purchase contract;
whether any warranty limitation or exclusion was validly agreed;
whether an additional voluntary guarantee was offered.
Nothing on this page replaces the signed purchase contract or any separate written guarantee certificate.
For used vehicles, the purchase contract may contain a lawful limitation or exclusion of statutory warranty rights, depending on the sale type and the applicable legal rules.
Examples of possible contract wording may include vehicles sold:
“as seen”;
“as inspected and test-driven”;
“without additional dealer warranty”;
“without warranty, as permitted by law”;
“for export only”;
“for trade sale only”;
“as a repair object”;
“ab Platz,” where clearly agreed and legally valid.
Any limitation or exclusion applies only as permitted by Swiss law. It does not protect the seller if the seller fraudulently conceals defects or gives false assurances.
In addition to any statutory rights and any voluntary guarantee that may apply, Ämmitau Garage GmbH offers customers a 14-day voluntary return policy on eligible cars, commercial vehicles, and motorhomes.
This means that the customer may reject and return the purchased vehicle within 14 calendar days from the date of handover or delivery.
If the vehicle is returned in accordance with this policy, Ämmitau Garage GmbH will fully refund all money paid by the customer for the vehicle purchase.
This 14-day return policy is a voluntary customer benefit offered by Ämmitau Garage GmbH. It is not intended to describe a general mandatory Swiss cancellation right.
To use the 14-day return policy, the customer must notify Ämmitau Garage GmbH in writing within 14 calendar days from the vehicle handover or delivery date.
The returned vehicle must be:
returned within the 14-day return period;
in substantially the same condition as at handover;
free from accident damage, misuse, abuse, or new damage caused after delivery;
complete with all keys, vehicle documents, manuals, service records, accessories, equipment, charging cables, remote controls, and registration-related documents supplied at handover;
free from unauthorised modifications, tuning, conversions, removals, or alterations;
not used for racing, motorsport, commercial hire, towing beyond permitted limits, overloading, or improper use;
not subject to any third-party rights, finance, pledge, seizure, or legal restriction created after delivery.
The customer must send a written return request to:
Ämmitau Garage GmbH
Brandisstrasse 25
3432 Lützelflüh-Goldbach
Switzerland
Email: info@falchauto.com
Telephone: (+41) 555 391 873
The return request should include:
customer name and contact details;
vehicle make, model, VIN, and mileage;
purchase date and handover or delivery date;
reason for return, if the customer wishes to provide one;
preferred return appointment date.
The customer does not need to prove a defect in order to use the voluntary 14-day return policy, provided the policy conditions are met.
If the vehicle is returned in accordance with this policy, Ämmitau Garage GmbH will refund the full purchase price paid by the customer for the vehicle.
The refund will normally be made using the same payment method used for the purchase, unless another method is agreed in writing.
The refund may be delayed until the vehicle, keys, documents, and accessories have been returned and inspected.
Unless otherwise agreed in writing, the vehicle must be returned to the agreed return location confirmed by Ämmitau Garage GmbH.
Vehicles may be returned by appointment at the vehicle park:
Müstair, 7537 Val Müstair
Kanton Graubünden
Switzerland
In addition to statutory rights and the 14-day voluntary return policy, Ämmitau Garage GmbH may offer a voluntary dealer guarantee on selected vehicles.
A voluntary dealer guarantee is an additional promise from the dealer. It applies only if it is expressly confirmed in writing in the vehicle advertisement, offer, order form, purchase contract, invoice, guarantee certificate, or other written document issued by Ämmitau Garage GmbH.
Where offered, the voluntary dealer guarantee may cover selected components such as:
engine;
gearbox;
drivetrain;
differential;
turbocharger;
steering components;
braking system components;
suspension components;
cooling system components;
electrical components;
fuel system components;
air conditioning components;
hybrid or electric drive components, if specifically included;
motorhome-specific systems, if specifically included in writing, such as habitation electrics, water system, heating system, refrigerator, gas system, leisure battery, auxiliary equipment, or living-area systems.
The exact guarantee coverage, duration, mileage limit, claim procedure, repair approval process, and exclusions are stated in the individual guarantee document.
If no voluntary dealer guarantee is confirmed in writing, no additional dealer guarantee is provided beyond the customer’s rights under the individual purchase contract and applicable Swiss law.
Unless expressly included in writing, a voluntary dealer guarantee usually does not cover:
normal wear and tear;
tyres, wheels, brake pads, brake discs, clutch wear, wiper blades, bulbs, lamps, batteries, filters, belts, fluids, and service parts;
cosmetic damage, scratches, dents, stone chips, paint defects, upholstery wear, interior trim damage, furniture wear, flooring wear, glass damage, or signs of normal use;
routine maintenance, inspection, servicing, adjustment, cleaning, lubrication, software updates, or diagnosis without a covered defect;
damage caused by accidents, misuse, negligence, racing, overloading, incorrect fuel, incorrect fluids, improper operation, or failure to follow instructions;
damage caused by lack of servicing or failure to follow manufacturer maintenance schedules;
unauthorised modifications, tuning, non-approved parts, camping conversions, or electrical alterations;
defects disclosed before sale;
defects caused after delivery;
consequential losses, including loss of income, loss of use, replacement vehicle costs, taxi costs, hotel costs, campsite costs, towing costs, recovery costs, storage costs, travel costs, or inconvenience, unless expressly covered in writing;
repairs carried out without prior written approval from Ämmitau Garage GmbH or the guarantee provider;
water ingress, damp, mould, frost damage, or damage caused by lack of ventilation, lack of maintenance, incorrect storage, or improper winterisation, unless expressly covered in writing;
motorhome equipment wear, ageing, or living-area deterioration unless specifically included in the guarantee document.
Some vehicles may still be covered by a manufacturer warranty. A manufacturer warranty is separate from:
statutory rights against the seller;
the 14-day voluntary return policy;
any voluntary dealer guarantee offered by Ämmitau Garage GmbH.
The existence, duration, transferability, and conditions of a manufacturer warranty depend on the manufacturer’s own terms.
Customers should check:
whether the manufacturer warranty is still valid;
whether it is transferable to the new owner;
whether the service history complies with manufacturer requirements;
whether missed services, modifications, imports, accident history, or non-approved parts affect coverage;
which repairs are covered;
where warranty repairs must be carried out.
Ämmitau Garage GmbH does not control manufacturer warranty decisions unless expressly stated in writing.
Unless otherwise stated in writing, vehicles sold by Ämmitau Garage GmbH are described according to their condition, age, mileage, inspection status, equipment, and available service history at the time of sale.
Used vehicles, cars, commercial vehicles, and motorhomes naturally show signs of age, mileage, wear, prior repairs, previous ownership, and normal use. These factors are considered when describing the vehicle and setting the purchase price.
Where known, relevant information may be recorded in the vehicle advertisement, inspection report, offer, order form, invoice, or purchase contract, including:
mileage;
service history;
accident history, if known;
import status, if applicable;
inspection or roadworthiness status;
known mechanical, electrical, bodywork, or interior defects;
missing keys, documents, accessories, or service records;
motorhome habitation equipment condition;
damp, water ingress, or living-area issues, if known;
any special sale conditions.
Customers are encouraged to inspect the vehicle carefully, ask questions, request available records, and arrange an independent inspection before purchase if desired.
Vehicles may be located at the vehicle park in:
Müstair, 7537 Val Müstair
Kanton Graubünden
Switzerland
Viewings, test drives, inspections, handovers, deliveries, and returns are by appointment only.
Unless otherwise agreed in writing, the use of the vehicle park or viewing location does not change the legal seller, which remains:
Ämmitau Garage GmbH
Brandisstrasse 25
3432 Lützelflüh-Goldbach
Switzerland
UID: CHE-287.349.598
If a customer believes that a vehicle has a defect covered by statutory warranty, a voluntary dealer guarantee, or another written guarantee, the customer should contact Ämmitau Garage GmbH before carrying out repairs.
Unless urgent safety measures are required, repairs should not be carried out by third parties without prior written approval from Ämmitau Garage GmbH or the guarantee provider.
The customer may be asked to provide:
purchase contract or invoice;
guarantee certificate, if applicable;
vehicle registration document;
service records;
diagnostic report;
photos or videos of the issue;
current mileage;
written description of the symptoms;
proof of proper maintenance, servicing, and use;
repair estimate, if requested.
After receiving the claim, Ämmitau Garage GmbH may request inspection of the vehicle before deciding whether the issue is covered.
If a vehicle develops a safety-related issue, the customer should stop using the vehicle as soon as it is safe to do so and contact Ämmitau Garage GmbH or a qualified repair workshop.
Examples of safety-related issues may include:
brake failure or brake warning lights;
steering faults;
serious engine overheating;
fuel leaks;
electrical smoke or fire risk;
tyre failure;
serious suspension faults;
warning lights indicating that driving may be unsafe.
The customer must take reasonable steps to prevent further damage and protect the safety of passengers and other road users.
Any voluntary dealer guarantee and the 14-day voluntary return policy are additional customer benefits. They do not remove, replace, or reduce any mandatory rights that the customer may have under applicable Swiss law.
Where statutory warranty rights have been validly limited or excluded in the individual purchase contract, the customer’s rights are determined by the contract and applicable Swiss law.
Nothing on this page limits liability where liability cannot legally be limited.
